good morning. 6:00. i'm marla tellez. >> i'm terry mcsweeney. jon and laura are off today. this morning b.a.r.t. trains are running as negotiations continue. while you were sleeping a federal mediator made the announcement saying both sides are still at the bargaining table despite the midnight deadline though. no strike has been called the threat still looming. christie smith live at caltrans headquarters in oakland where a marathon session wraps up. what can you tell bus this? >> reporter: good morning to you. they have been at it since about noon yesterday and as you said maybe about 30 minutes ago the mediator walked out and couple of brief words. saying that both sides would take a recess and be back at it talking again this afternoon. we tried to talk with some of the union leaders who normally have something to say but today they told us they are under a gag order and cannot share information. does that mean they are closer to a deal? that's unclear. i can tell that you everyone who

walked out looked awfully tired. the question of course where did they stand. b.a.r.t. and the unions talking since yesterday well past the midnight deadline with trains still rolling today. the talks have produced productive and constructive bargaining. b.a.r.t. presented a last and final offer that angered some of the unions that they thought it signaled an end to the talks. then they said that b.a.r.t. was taking a look and that mediator he had this to say. >> a recess until early this afternoon. and that's all i'm going to have to say at this moment. negotiations are continuing. and we will be back at it early this afternoon. >> we did see b.a.r.t.'s general manager come out at the same time about 30 minutes ago so she has been at the table a sticking point with b.a.r.t. workers who say they want her there to see

what's going on. of course 400,000 of b.a.r.t.'s daily riders for them. what we can tell su talks resume at 1:00 this afternoon. christie smith, "today in the bay." >> ac transit issuing notice of a possible strike on thursday. union work here's could walk off the job include 180 bus drivers and others. they will walk off at 12:01 thursday if an agreement is not reached. workers are looking for better pay it's a proposal to increase their health care contributions by about $50 a month. on saturday the union rejected a proposed contract. ac transit releasing this statement. we did receive the notice and we are reviewing it to determine what steps to take next. >> of course the on going

safety rules. it was yesterday morning that edward lake jr., a 60-year-old man from vacaville, was killed while delivering a load of rebar steal on behalf of his employer. you could see this from a construction sight. you can see a large bundle of rebar on the ground. we believe it's that bundle that crushed him to death. the exact details unknown. santa clara police say it was an accident. now it will be up to cal osha to make sure that the rules were followed. one civil engineering expert we spoke with wonders if the fast pace of this project played a role and in another accident that killed a worker earlier this year. >> studies that show that with

city counsels tool approve a plan to install crime fighting cameras. what's different about this plan they are going to incall them in low and moderate income. here are some of the neighborhoods they are considering. the ard an wood, central downtown t the south donedale neighborhood and the nils district. police say it's not intend to forrous on one type of resident. the police department plans to pay for the 20 cameras with grant money. the start-up cost for the surveillance system will run about 450,000, and police will have to find a wye to fund it. some are voicing concerns that the cameras have a feeling of big brother watching and they fear the city could invade their privacy. recently in some of the affluent neighborhoods here neighbors

thursday, the fog will kourn early and temperatures cooler at the coast. nice and warm inland. 76 in san francisco. wednesday into thursday there are the changes, temperatures level off thursday into friday. saturday great for the beach up to 85 degrees. but by sunday the temperatures tumble. mostly cloudy and nice sunny afternoon. >> let's check on the drive. here is mike inouye. >> it is traffic tuesday. we have those fast track lanes backed up as well as the cash lane. as you approach they are open. this is typical so thins burst. we'll look at the map and show you there is nothing unusual about the flow. slowing out of richard into berkeley. a crash cleared from the roadway but it's on the solder.

2 foyr. we're watching for additional showing. the rest of the east bay okay for the walnut creek interchange. southbound 892, an earlier crash moved to the shoulder. that's right by the transition to 92. adding a little bit of the slowing we see. the northbound side of 880 another crash there. this is in the center divide. it might be enough to kick off this slowing which we have seen pop up as that crash was reported so there you go through fremont. fine in the northbound direction, but southbound there is an issue, disabled vehicle that has clored to the shoulder. there is the slowing out of the alta mont pass a. look at the peninsula side out of the south bay. there are no problems for sante fe. back to you. >> good news. thank you. 6:21.

another dry ice bomb explodes. >> what an investigators are saying about a possible fortive and if it could be linked to terror.

new details about the second dry ice bomb to go off at l.a.x. in the past few days. police say the dry ice bomb that

exploded last night was found below an airplane right at the gate. two other similar devices were also found nearby outside the airport's tom bradley international terminal. those two did not go off. this is the second dry ice explosion at l.a.x., on sunday night a dry ice bomb went off 18 men's bathroom no. one was hurt in either explosion. police do not believe the incidents are acts are of terrorism but they are looking for the person responsible. >> this morning fairfield police are searching for an arsonist. police believe the man in the photos we're about to show you start add fire in the walmart on north texas street early yesterday morning. fire caused several containers to explode. no one was hurt. >> earlier this year our investigative unit exposed major problems with santa clara county's restaurant inspection system. today the first step in repairing the problems begins. the department of environ itle health will hold the first in a series of meetings this month.

negotiations. it's possible that a strike could come any time. but again, this morning b.a.r.t. trains are running as usual. >> this morning day 15 of the government shutdown and we are now just two days away from the debt ceiling deadline. tracie potts joins us live from kill. we understand some hope in the senate, republicans and democrats have agreed on the basics of a deal. >> reporter: exactly. that they move forward we've got to see if the republicans in the house are going to buy into it. now it looks like the top two in the senate harry reid and mitch mcconnell, are both saying signs are encouraging. there is a lot of progress. here is that deal as we know it at this hour being presented to both sides later today. it would put a budget in place that would get all of the furloughed workers back to work, and extend that budget through the middle of january. the u.s. would be able to borrow money to pay bills after thursday, through early february, maybe a little later. here's the caveat.

lawmakers would have to get together before the end of this year and come up with a budget. that could be a challenge. something more permanent than what they are doing here. this would get things rolling again. both sides get a look at it today. even if it passes the senate a lot of knds of conservatives in house not happy with now the negotiations proceeded and we've only got two more days until that deadline for possible default. >> thank you very much. a deal to end the shutdown is not coming soon fluff for lawrence livermore lab employees. this morning employees at the nationally renowned lab will begin shutdown operations. the lab is one of the country's leading research centers in nuclear and computer science. more than 6,000 people work there making it the second largest employer in alameda county behind uc-berkeley. most of the lab will be closed by end of day tomorrow. >> let's check the forecast. christina loren has forgiven me for whatever i did earlier.

have. the b.a.r.t. trains are running. our chopper is over the west oakland b.a.r.t. station. a flashing light a reflection. we have smooth traffic. the trains will be moving. we see one of them at the station as folks board and make their way. there is a delay for the fremont line, fremont and richmond. a report after 15-minute delay which happened early. it continues for the line because of a reported equipment problem. the rest of the lines are operating on time. ac transit is moving. their buses. we have the watch on their potential for a strike in a couple of days. meanwhile t the roads, typical traffic tuesday. the build so out of ka knoll your typical flow. we have a couple of issues. reports after crash. quickly moved to the shoulder

but that is enough sometimes to cause additional slowing so. far the sensors are holding over the last five minutes. north 680, reports after crash or stalled vehicle. waiting to get clarification. it is southbound 680 out of pleasant hills kiptal for that walnut creek area. south 880 toward earlier crash at 92, there is paperwork but it's off of the highway. union city south 880 and north as there is another crash in the center divide which might distract the commute. that's where we see the orange. back to you. >> thanks. a man who lives a it a south bay home day care for kids faces charges ever sexual abuse. the 68-year-old is accused of molesting two children. the alleged abuse happened off south wolf road.

he is the father of the day care owner. the day care center remains open for business, the license is in good standing with only one complaint relating to an aggressive dog. >> also in the south bay a young boy is in the hospital after he was hit by a train. the boy was hit when the train was pulling into the station about 7:30 last night. it's not clear how badly the boy is hurt. the boy is between 4 and 7 years old. the sheriff's accident reviewing video from the platform and from the front of the train to help berm what happened. >> police investigate a shooting in the lower hate neighborhood. completes police found three people shot. one person died. the other two are expected to survive. homicide detectives working the case. so far no arrests. >> 6:36. still ahead almost 100 feared

little more than an hour ago with a federal mediator saying that he got both sides to keep talking well past the union's midnight strike deadline. we also tried to speak with a couple of the union leaders who normally have something to say. this time one told us she was under a federal gag order not to speak. the mediator said that the talks have produced some productive and constructive bargaining. described in negotiations as intense. b.a.r.t. yesterday presented a best and final offer. that actually upset the union saying to them it signaled the end of talks. then the unions went ahead and said they presented a counter offer. b.a.r.t. was considering that. the mediator stopped to say this on his way out. >> at the mediator's request we'll take a recess until early this afternoon. that's all i'm going to have to say at this moment. negotiations are continuing. and we will be back at it early

what a treat at 6:47. right around 7:15, depends on where you live. let's start with san jose. isn't that lovely. >> it is. >> only to be trumped by san francisco thisz morning. what a beautiful clear sky. i would say it onlyz trumps the shot of san jose because there is no fog. we're going to stay fog-free for one more day, then clouds move in. temperatures are cold. we have no blanket of cloud cover to trap in warmth so it's a frigid start in santa rosa and napa holding strong at 38 degrees. we could drop off even more so as we head through the next 15, 20 minutes into the coldest point of the entire day. the reason why, it is so clear out there at the coastline, look at all of the wind arrows pointing out to sea. that's off shore flow.
